Welcome to Travely Inc. These Terms and Conditions ("Terms") govern your access to and use of our website, mobile experiences, and the travel-related services we provide. Please read them carefully: together with our Privacy Policy and the terms and conditions of the suppliers that operate the services included in your trip, they form the entire agreement between you and Travely Inc.
By accessing our website, creating an account, requesting a quote, or confirming a booking, you agree to be bound by these Terms on your own behalf and on behalf of every traveler included in your booking. If you make a booking for other people, you confirm that you are authorized to accept these Terms for them and that you will inform them of the rules, restrictions, and policies that apply to their travel arrangements.
If you do not agree with any part of these Terms, you must not use our website or our services. These Terms contain provisions that limit our liability, require individual (non-class) claims, and select the governing law and venue for disputes.
Travely Inc. is a duly registered travel agency in the State of Florida, USA. We hold an active Florida Seller of Travel License (No. ST44920) and are accredited by the Airline Reporting Corporation (ARC Certification No. 10590086).

In these Terms, "Travely", "we", "us", and "our" refer to Travely Inc. "You", "your", "traveler", and "client" refer to the person who makes the booking and to every person included in it.
You must be at least 18 years old and have the legal capacity to enter into binding contracts in order to make a booking. Minors may travel only when accompanied by an adult who assumes responsibility for them, and additional documentation may be required by airlines or destination authorities.
If you create an account, you are responsible for keeping your credentials confidential and for all activity carried out through your account. You must notify us immediately of any unauthorized use. We may suspend or terminate accounts that we reasonably believe are being used fraudulently, abusively, or in breach of these Terms.
We will communicate exclusively with the person named as the lead traveler on the booking, who is responsible for transmitting our communications to the rest of the party.
Travely Inc. acts as an agent that organizes, combines, and sells travel arrangements operated by independent Suppliers. We do not own, control, manage, or operate the aircraft, hotels, vehicles, restaurants, or activities included in your trip.
All bookings are additionally subject to the terms, conditions, tariffs, and contracts of carriage of the applicable Suppliers, which may limit or exclude their liability, often under international conventions such as the Warsaw and Montreal Conventions for air travel. By confirming a booking, you accept those supplier terms as part of your agreement with us. Copies or references are available upon request.
We select our Suppliers with due diligence, but we are not responsible for the acts, errors, omissions, misrepresentations, warranties, breaches, negligence, insolvency, or bankruptcy of any Supplier, nor for any personal injury, death, property damage, delay, or other loss or expense resulting therefrom.
Travely Inc. provides travel booking services including but not limited to flights, hotels, vacation packages, transfers, car rentals, and activities, available through our website and through our customer service team. We may apply agency fees for planning, advice, bookings, changes, refunds, and cancellations, and we may require a deposit when a custom package is requested.
Descriptions, photographs, itineraries, hotel categories, and inclusions published on our website are indicative and may be updated by the Supplier. Hotel star ratings follow local classification standards of each destination and may not be equivalent between countries. Where a specific hotel, activity, or route becomes unavailable, we may replace it with an alternative of comparable standard.
You are responsible for reviewing what is and is not included in each Trip Package before completing your purchase. Unless expressly stated, prices do not include meals, gratuities, optional excursions, local taxes payable at destination, visas, vaccinations, personal expenses, or travel insurance.
An online booking process must be completed to reserve your trip; in some cases our customer service team may complete it on your behalf. A binding agreement comes into existence only when we issue a booking confirmation. Until then, prices, availability, and inclusions remain subject to change and to confirmation by the Suppliers.
Availability and pricing displayed on our website are obtained in real time from third-party systems and may change or expire before your payment is completed. We make every effort to keep the information on our website accurate, but obvious errors — including manifest pricing errors caused by technical or human failure — may be corrected. If an error affects a confirmed booking, we will inform you as soon as possible and offer you the choice of accepting the corrected price or cancelling the booking with a full refund of the amounts paid.
Please review every detail of your booking, including names, dates, airports, and traveler information, before submitting it. Changes after confirmation may be impossible or subject to fees, as described in Section 14.
All prices listed on our website are quoted in US dollars unless stated otherwise, are subject to change without notice until a booking is confirmed, and may vary due to currency fluctuations, supplier changes, availability, and tax updates. Prices depend on the dates, occupancy, room and hotel selection, activities, and flight options you choose.
Certain bookings may incur additional fees or local charges that are not collected at the time of purchase, such as resort fees, city or tourist taxes, environmental fees, entry or departure taxes, security deposits, parking, or fees for optional services. These amounts are payable directly to the Supplier or the local authority, and it is the traveler's responsibility to pay them when applicable.
Service or handling fees charged by Travely, as well as the cost of the Cancellation Coverage, are non-refundable.
All card transactions are securely processed through Stripe. Travely Inc. does not store your full card details. By providing your payment information, you authorize us and our payment processor to charge the amounts corresponding to your booking, including any add-ons, taxes, and fees you have selected. Additional verification steps may be requested to prevent fraudulent transactions, and we may decline or cancel a booking when verification cannot be completed.
Where a deposit or an installment plan is offered, the remaining balance must be paid by the dates communicated to you. If any payment is not received in full and on time, we may treat the booking as cancelled by you, and the cancellation conditions in Section 14 will apply. Bookings made close to the departure date must be paid in full at the time of booking.
You agree to raise any billing dispute with us before initiating a chargeback. Initiating a chargeback for amounts that are legitimately non-refundable under these Terms constitutes a breach of this agreement, and you may be liable for the costs we incur in disputing it.
Travel Credit may be issued to your Travely Wallet as a reward, as a promotional benefit, or as the result of a cancellation under the Flex plan of the Cancellation Coverage. Unless expressly stated otherwise in the applicable program rules:
We may operate referral, rewards, or promotional programs. The specific benefits, amounts, eligibility rules, and payout conditions of each program are published on the corresponding page of our website and form part of these Terms. Rewards are generally confirmed only after the referred booking has been fully paid and the trip has taken place, and they may be withheld or reversed in cases of cancellation, chargeback, duplicate accounts, self-referral, or any conduct we reasonably consider abusive or fraudulent.
Promotional codes and discounts cannot be combined unless expressly stated, have no cash value, are valid only for the period and products indicated, and may be modified or discontinued at any time without prior notice for bookings not yet confirmed.
You are responsible for providing complete and accurate personal information, including but not limited to full names exactly as they appear on the passport or government-issued ID, dates of birth, identification and passport numbers, nationality, and contact information for all travelers associated with your booking.
Airlines and other Suppliers may refuse boarding or service, or charge correction fees, when the information provided does not match the traveler's official documentation. Travely Inc. disclaims liability for any cost, denial of service, or loss arising from inaccurate, incomplete, or late information supplied by you, and you agree to reimburse us for fines or charges we incur as a result.
Upon booking, you will receive a confirmation email with your travel itinerary and invoice. It is your responsibility to review all documents immediately upon receipt and to notify us of any discrepancy without delay. Travel documents, vouchers, and e-tickets are generally delivered electronically to the email address associated with your booking; you must ensure that the address is correct and able to receive our messages.
Travelers must obtain and carry all required documentation, such as passports, visas, transit permits, and vaccination certificates, as described in Section 16.
Travely Inc. offers an optional Cancellation Coverage add-on (Cancel For Any Reason – CFAR) that allows the traveler to cancel the trip and recover 100% of the amount paid, either as Travely travel credit or as a refund, under the conditions described in Section 14.1 below. When this coverage is purchased, the cancellation is handled directly by Travely Inc. and the traveler does not depend on the refund policy of each supplier. When it is not purchased, the booking is non-refundable, and any refund, cancellation, or modification is subject to the terms, conditions, and policies established by the respective third-party suppliers, including but not limited to airlines, hotels, and tour operators. In those cases, Travely Inc. acts solely as an intermediary and does not control or guarantee the outcome, eligibility, or timeline of any refund request. Refunds, when approved by the supplier, may take up to 90 days or longer to be processed, depending on the supplier’s internal procedures, payment methods, and banking systems. By confirming a booking, the client acknowledges and agrees to comply with all applicable third-party terms, including any penalties, fees, or non-refundable conditions that may apply.
All cancellation requests must be submitted in writing through our contact channels. A request takes effect on the date and time it is received by our customer service team, or on the next business day when it is received outside our operating hours.
At the time of the initial reservation, Travely Inc. may offer an optional Cancellation Coverage add-on that allows the traveler to cancel for any reason (“CFAR”), without having to provide a justification or supporting documentation. The price of each plan is calculated from the trip total (package plus flight), and is displayed per traveler during the booking process before any payment is made. Two plans are available:
The Cancellation Coverage is subject to the following conditions:
Cancellation Coverage is a commercial policy offered directly by Travely Inc. It is not an insurance product, is not underwritten by an insurer, and does not replace the travel insurance described in Section 15.
Requests to modify a confirmed booking — including dates, destinations, hotels, activities, occupancy, or traveler names — must be submitted in writing as soon as possible. We will make reasonable efforts to accommodate them, but we cannot guarantee that a change is possible.
Where a change can be arranged, you must pay any difference in price, any supplier penalty, and any handling fee applicable at that time. Airline tickets, once issued, are generally non-changeable and non-refundable, and any alteration may incur a charge of up to 100% of the value of that component. Name changes are usually treated by airlines as a new booking. If a requested change cannot be arranged and you decide not to proceed with the original booking, the request will be treated as a cancellation and the conditions of this Section 14 will apply.
Because travel arrangements are planned in advance, Suppliers occasionally modify their services. Minor changes — such as a change of flight schedule, a change of accommodation to another of a similar standard, or a variation in the order of the itinerary — may be made without liability on our part, although we will inform you as soon as reasonably possible.
If we have to make a significant change to your confirmed arrangements, or if we must cancel your booking, we will notify you as soon as possible and, where there is time before departure, offer you the choice of accepting the modified arrangements, accepting alternative arrangements of comparable standard (paying or being credited any price difference), or cancelling with a refund of the amounts paid to us. You must notify us of your choice within the period indicated in our communication; otherwise we will assume that you accept the modified arrangements. These options and any compensation do not apply where the change or cancellation results from Force Majeure, from your failure to pay on time, or from a change you requested.
Services that are not used, including flights, hotel nights, transfers, and activities, whether due to late arrival, no-show, voluntary decision, denied boarding, or denied entry to a country, are not refundable and do not entitle you to compensation or to a replacement service. Please note that failing to use an outbound flight segment usually causes the airline to cancel the remaining segments.
We strongly recommend purchasing comprehensive travel insurance to protect against unexpected events such as medical emergencies, repatriation, delays, and lost luggage. Some countries require foreign visitors to hold valid medical insurance in order to be admitted, and we cannot be held responsible if entry is denied because you are unable to evidence adequate coverage.
Insurers usually limit the time between the booking date and the issuance of the policy, so we recommend purchasing it immediately after receiving your booking confirmation. Travely Inc. is not responsible for losses incurred by travelers who elect not to purchase adequate coverage. Travel insurance claims are processed directly between the traveler and the insurance provider; Travely provides the required documentation but does not process or receive insurance reimbursements.
Travel insurance is separate from, and complementary to, the Cancellation Coverage described in Section 14.1.
It is your responsibility to verify and comply with the passport, visa, transit, immigration, customs, and health requirements applicable to every traveler, destination, and connection point in your itinerary. We can only provide general guidance; requirements depend on nationality and personal circumstances and change frequently. You must confirm the current requirements with the relevant embassies, consulates, airlines, and health authorities in good time before departure.
Most countries require passports to be valid for at least six months beyond the return date, and many require electronic travel authorizations. Documents such as driver's licenses, expired or damaged passports, or police reports are generally not accepted as valid travel documents. All travelers, including infants and children, must carry their own valid documentation.
Travely Inc. accepts no responsibility and provides no refund if you are unable to travel, are denied boarding, or are refused entry or transit because you did not meet these requirements, and you agree to reimburse us for any fine or cost we incur as a result. Any expense caused by health requirements at destination, including tests, quarantine, or additional nights, is your responsibility and must be claimed, where applicable, from your insurer.
Flight times shown during the booking process are indicative and subject to change; the applicable times are those shown on your e-ticket. You must check your e-tickets carefully upon receipt and reconfirm your flights with the airline within 48 hours before departure, as airlines may change schedules or cancel flights even after tickets have been issued.
Airlines are solely responsible for the conditions of carriage, including schedules, routes, stops, aircraft type, cabin configuration, seat assignment, baggage allowances and fees, overbooking, delays, and cancellations. Travely Inc. is not liable for those decisions or for their consequences, and any compensation for denied boarding, delay, or cancellation must be claimed directly from the airline.
Once issued, tickets are generally non-refundable, and any change is subject to the airline's fare rules and fees. We recommend arriving at the airport well in advance of departure and verifying check-in and baggage rules directly with the operating carrier.
Hotel check-in and check-out times are set by each property, and early check-in or late check-out cannot be guaranteed. Rooms are assigned by the hotel; bedding configurations, connecting rooms, floors, and views are requests unless expressly confirmed as part of your booking.
Hotels may require a credit card at check-in as a guarantee for incidentals and may charge local taxes, resort fees, or deposits directly to the guest. Facilities such as pools, spas, restaurants, or entertainment may be temporarily unavailable due to maintenance, weather, seasonality, or local regulations, which does not entitle the traveler to a refund.
If a hotel included in your Trip Package becomes unavailable, we will arrange a replacement of comparable or higher category whenever possible.
Activities, excursions, tours, and transfers are operated by independent Suppliers and are subject to their own schedules, minimum participant numbers, age or health restrictions, and cancellation rules. Operators may modify or cancel an activity for reasons such as weather, safety, or insufficient participants; in that case we will seek an alternative or refund the amount corresponding to that activity when the Supplier refunds it to us.
You are responsible for arriving at the indicated meeting point on time and for complying with the operator's safety instructions. Services purchased or arranged directly by you at destination are not part of your agreement with Travely, and we accept no responsibility for them.
Special requests must be notified at the time of booking and confirmed by us in writing. We will pass them on to the relevant Suppliers, but a request noted on a confirmation does not amount to a guarantee that it will be met, and a failure to fulfill it does not constitute a breach of these Terms unless it was expressly confirmed as part of the booking.
If any traveler has a disability, reduced mobility, or a medical condition that may affect the trip, you must inform us in full before the booking is confirmed so that we can assess whether the arrangements are suitable. Acting reasonably, we may decline the booking, or treat it as cancelled by you when the information is disclosed after confirmation, if we cannot properly accommodate the traveler's needs.
If, in our reasonable opinion or in the opinion of any person in authority, the behavior of a traveler causes or is likely to cause danger, distress, damage, or annoyance to others or to property, or a delay or diversion to any means of transport, we and our Suppliers reserve the right to terminate that traveler's arrangements immediately. In such a case, our obligations cease, no refund or compensation is due, and any resulting cost, including repatriation, is the traveler's responsibility. You will also be responsible for any loss or damage you cause to a Supplier's property.
If a problem arises during your trip, you must report it immediately to the local Supplier so that it can be addressed on the spot, and contact our customer service team using the channels provided in your travel documents. Failure to report a problem while at destination may prevent it from being resolved and may affect any subsequent claim.
If the matter remains unresolved, you must send us a written complaint within 30 days after the end of your trip, including your booking reference and all relevant information and evidence. We will acknowledge and investigate your complaint and respond within a reasonable period.
Travely Inc. shall not be liable for any failure or delay in performance, nor pay compensation, when it results from events beyond our reasonable control or that of our Suppliers, including but not limited to natural disasters, severe weather, fire, epidemics or pandemics, war or threat of war, terrorism, civil unrest, strikes and labor disputes, airport or port closures, air traffic control restrictions, technical or IT failures, governmental or health authority actions, and travel advisories or restrictions.
Travel involves inherent risks, which may include differing standards of safety, sanitation, and medical care; transportation by air, sea, rail, and road; interaction with animals and natural environments; adventure or physical activities; political instability; crime; and limited access to rapid evacuation or medical facilities in remote areas. By booking, you acknowledge these risks, voluntarily assume them for yourself and the travelers in your booking, and accept responsibility for your own travel decisions, including decisions to travel to destinations subject to security advisories.
To the maximum extent permitted by law, Travely Inc. shall not be liable for any indirect, punitive, incidental, special, or consequential damages, nor for loss of enjoyment, profit, or opportunity, arising out of or connected with your use of our website or services. Our website and its content are provided "as is", without warranties of any kind regarding uninterrupted availability or the absence of errors.
Our maximum aggregate liability for any claim shall not exceed the total amount paid to Travely Inc. for the travel services giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence or for fraud.
Baggage and personal belongings travel at the owner's risk and must be supervised at all times; claims for loss, damage, or delay must be filed directly with the carrier in accordance with its conditions and the applicable international conventions.
You agree to indemnify and hold harmless Travely Inc., its officers, employees, and agents from any claim, liability, loss, fine, or expense, including reasonable attorneys' fees, arising from your breach of these Terms, from inaccurate information you provide, from your conduct during the trip, or from your failure to comply with documentation, immigration, or health requirements.
By providing your contact details, you agree to receive service communications related to your booking by email, telephone, and, where you have expressly consented, by SMS or messaging applications. Service messages are not marketing messages and are necessary to operate your trip.
Marketing communications are sent only with your consent and can be discontinued at any time using the unsubscribe link included in our emails or by replying STOP to our text messages, where applicable. Message and data rates may apply. Details on how we handle your data are described in our Privacy Policy.
You agree to use our website only for lawful purposes and for genuine travel enquiries and bookings. You must not make speculative, false, or fraudulent reservations; use automated systems to access, scrape, or copy content or prices; attempt to gain unauthorized access to our systems or accounts; interfere with the normal operation of the website; or use it in any way that infringes the rights of others. We may suspend access and cancel bookings associated with such conduct.
If you submit reviews, photographs, comments, or other content to our website or social channels, you grant Travely Inc. a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, and display that content for promotional and operational purposes. You confirm that you own the necessary rights to the content and that it is not unlawful, offensive, or misleading. We may remove any content at our discretion.
All content on our website, including trademarks, logos, text, graphics, images, itineraries, databases, and code, is the property of Travely Inc. or licensed to Travely Inc. and is protected by intellectual property laws. Unauthorized use, reproduction, distribution, or duplication is prohibited without our express written consent.
Your personal information is collected and used according to our Privacy Policy. By using our services, you consent to our collection and use of personal data for booking and operational purposes, including sharing the information necessary with third-party providers to complete your travel arrangements, some of which may be located outside your country of residence.
Travely Inc. reserves the right to update or modify these Terms at any time. The version in force at the moment your booking is confirmed governs that booking, except for changes required by law. Your continued use of the website and services following the publication of revised Terms constitutes your acceptance of them.
These Terms and any agreement to which they apply are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute, claim, or matter arising out of or in connection with your booking or these Terms shall be brought exclusively before the state or federal courts located in Palm Beach County, Florida, and both parties submit to their jurisdiction.
You agree to bring any claim against us only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You further agree to notify us in writing of any claim within 30 days after the end of the trip or after the cancellation of the booking, before initiating any legal action.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any provision does not constitute a waiver of it. You may not assign your rights under these Terms without our written consent; we may assign ours in connection with a corporate reorganization or transfer of business. These Terms, together with the documents referred to in them and the applicable Supplier conditions, constitute the entire agreement between you and Travely Inc. Section headings are for reference only. In case of discrepancy between translated versions, the English version prevails.
